1. Agreement to these terms

These Terms of Service ("Terms") govern your access to and use of this website and the services offered through it (together, the "Services"), operated by SWCM LLC, doing business as Winston Dane ("Winston Dane," "we," "us," "our"). By using the Services or submitting a form, you agree to these Terms. If you do not agree, please do not use the Services.

We may update these Terms from time to time. We will revise the "Last updated" date above, and your continued use after a change means you accept it. Our Privacy Policy is incorporated into these Terms by reference.

2. Who we are & what this site is

Winston Dane is a licensed real estate brokerage team affiliated with eXp Realty, serving Lake Norman and Greater Charlotte, North Carolina. Wendy Atherton (NC Lic. 305942) and Sean Herndon (NC Lic. 299279) are the licensed brokers.

This website provides general real estate information and a way to contact us. Nothing on this site is legal, tax, financial, appraisal, or investment advice, and nothing here creates an agency or brokerage relationship. A brokerage relationship is formed only by a signed written agreement and the agency disclosures North Carolina law requires.

3. Permitted use

You must be at least 18 years old to use the Services. You agree to provide accurate information and to use the Services only for lawful, personal, non-commercial purposes. You agree not to:

• scrape, crawl, harvest, or bulk-download content or listing data;
• submit another person's contact information or phone number without their permission;
• interfere with, overload, or attempt to gain unauthorized access to the Services;
• use the Services to send unsolicited commercial messages; or
• copy, republish, or redistribute our content without written permission.

We may suspend or terminate access to the Services at any time, with or without notice, for conduct that violates these Terms.

4. Communication preferences — calls & texts

When you submit a form, you are asking us to respond, and we may reply by email or phone about your inquiry and any transaction you engage us for.

You may unsubscribe from marketing email at any time using the link in any message. Even after you opt out of marketing, we may still send transactional messages about an active transaction.

5. Listing information

Property information on this site may be supplied by third parties, including multiple listing services and their data feeds. It is deemed reliable but not guaranteed and is provided exclusively for consumers' personal, non-commercial use, and may not be used for any purpose other than to identify prospective properties consumers may be interested in purchasing. Availability, pricing, taxes, square footage, school assignments, and property condition change without notice and must be independently verified. Some listings may be excluded from this website. Any estimate of value we provide is a market opinion, not a licensed appraisal.

6. Fair housing

Equal Housing Opportunity. Winston Dane at eXp Realty complies with all federal, state, and local fair housing laws. We do not discriminate on the basis of race, color, religion, sex, handicap, familial status, or national origin. We do not answer questions about the racial, religious, or ethnic composition of neighborhoods, and we direct such questions to publicly available data.

7. Intellectual property & DMCA

The content, design, photography, video, text, and trademarks on this site are owned by Winston Dane or its licensors and are protected by United States intellectual property law. You receive a limited, revocable, non-transferable license to view this site for personal, non-commercial use. All other rights are reserved.

Notice of claimed infringement. This website republishes real estate listing content — including photographs, video, and property descriptions — that is supplied through the multiple listing service and owned by other brokerages and third parties. If you believe in good faith that content on this website infringes a copyright you own or are authorized to act for, you may send a written notice to our Designated Agent, identified below. To be effective under 17 U.S.C. § 512(c)(3), your notice must include: (a) your physical or electronic signature; (b) identification of the copyrighted work you claim has been infringed; (c) identification of the material you claim is infringing, with information reasonably sufficient for us to locate it, such as the page address; (d) your name, mailing address, telephone number, and email address; (e) a statement that you have a good faith belief the disputed use is not authorized by the copyright owner, its agent, or the law; and (f) a statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or authorized to act on the owner's behalf. We will respond expeditiously to remove or disable access to material that is the subject of a valid notice.

Counter-notification and repeat infringers. If material you posted was removed or disabled and you believe the removal was the result of mistake or misidentification, you may send a written counter-notification to the Designated Agent above. Under 17 U.S.C. § 512(g)(3) it must include: (a) your physical or electronic signature; (b) identification of the material that was removed and the location at which it appeared before it was removed; (c) a statement, made under penalty of perjury, that you have a good faith belief the material was removed or disabled as a result of mistake or misidentification; and (d) your name, mailing address, and telephone number, together with a statement that you consent to the jurisdiction of the federal district court for the judicial district in which your address is located — or, if your address is outside the United States, the Western District of North Carolina — and that you will accept service of process from the person who submitted the original notice or their agent. We may replace the removed material in ten to fourteen business days unless the original complainant notifies us that they have filed an action seeking a court order to restrain the allegedly infringing activity. It is our policy, in appropriate circumstances, to disable or terminate the accounts or access of users who are repeat infringers.

8. Disclaimers & limitation of liability

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the Services will be uninterrupted, error-free, or that any content is accurate or current.

TO THE FULLEST EXTENT PERMITTED BY LAW, WINSTON DANE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS OR DATA, ARISING FROM YOUR USE OF THE SERVICES. Nothing in these Terms limits any liability that cannot be limited under applicable law, and nothing here limits the duties a licensed North Carolina real estate broker owes a client under a signed brokerage agreement.

This site may link to third-party websites we do not control. We are not responsible for their content, practices, or privacy policies.

9. Governing law

These Terms are governed by the laws of the State of North Carolina, without regard to its conflict of laws rules. You agree to the exclusive jurisdiction and venue of the state and federal courts located in Iredell County or Mecklenburg County, North Carolina. If any provision of these Terms is found unenforceable, the remaining provisions stay in effect.
